Probate without a will
If the deceased person died without having a will, they die "intestate." In this situation, the court follows Texas intestacy laws to distribute the assets of the decedent.
Probate with a will
If the deceased person had a will, the court determines that the will is valid and authentic. After this determination the court appoints a personal representative (executor or administrator) to administer the estate.
